These Terms of Service ("Terms") govern your use of avysera.com (the "Site") and any purchase from Avysera. By using the Site or placing an order you agree to these Terms.

1. Our products

Avysera Energy & Focus™ gum contains caffeine (40mg per piece). It is a food/confectionery product, not a medicine: it is not intended to diagnose, treat, cure or prevent any disease, and individual results vary. It is not recommended for children under 18, people sensitive to caffeine, or pregnant or breastfeeding women. Always read the label and use as directed. If you have a medical condition or take medication that interacts with caffeine, talk to your doctor before use.

2. Orders & acceptance

Placing an order is an offer to purchase. We may decline or cancel orders (e.g. suspected fraud, pricing errors, stock issues) — if we cancel after payment, you receive a full refund. You confirm the details you provide are accurate and that you're at least 18 or ordering with a guardian's consent.

3. Pricing & payment

Prices are shown in your local currency where supported and may change at any time without notice; the price at checkout is the price you pay. Payment is processed securely by our payment providers. Your card statement will show a billing descriptor referencing AVYSERA. Obvious pricing errors may be corrected even after order confirmation, with a full refund offered.

4. Shipping, returns & subscriptions

Shipping timeframes, our 30-day money-back guarantee and subscription terms are set out in our Shipping Policy, Return Policy and Subscription Terms, which form part of these Terms.

5. Acceptable use

You agree not to misuse the Site — including attempting to breach its security, scraping content at scale, placing fraudulent orders, or using the Site in violation of any applicable law.

6. Intellectual property

All Site content — text, images, branding, layout — belongs to us or our licensors. You may not reproduce it commercially without written permission.

7. Liability

To the maximum extent permitted by law, we exclude all implied warranties, and our total liability for any claim connected to an order is limited to the amount you paid for that order. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law or other applicable consumer protection laws — including consumer guarantees that goods are of acceptable quality and fit for purpose.

8. Governing law

These Terms are governed by the laws of New South Wales, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts.

9. Changes

We may update these Terms from time to time; the version on this page at the time of your order applies to that order.
